Website use
Terms of use
These terms govern access to the site and online features outside the sales contract. Purchases are governed by our terms and conditions of sale (T&Cs).
Purpose
These general terms of use (“ToU”) set the rules for accessing and using the website operated as “Averazon”, and related online services (account creation and management, participation in “Team Drops” group-buy campaigns in the sense of browsing and technical engagement on the platform, and other features offered).
They complement any notice or rule shown in the interface. If an information notice conflicts with the ToU, the provision most favourable to the end user applies, without prejudice to mandatory law.
Definitions
For the purposes of the ToU:
- “Site” means all pages, APIs or features available from Averazon’s official domain and subdomains.
- “User” means anyone who browses the Site, with or without an account.
- “Account” means the personal area created after sign-up and authentication.
- “Content” means text, images, video, pseudonyms, messages, data or files transmitted or made available by a User through the Site.
- “Publisher” means the entity identified under “Publisher” below.
Publisher
The Site is published by Alexandre Buathier, sole trader, trading as “BEWED”, operating the “Averazon” brand and website, registered under SIRET 804 119 675 00028.
Acceptance and enforceability
Accessing and using the Site means you fully accept these ToU. If you do not agree, you must stop using the Site.
The ToU are binding from the date they are published online and, where applicable, from acceptance when the Account is created. The Publisher may refuse access to the Site to any User who fails to comply with the ToU.
Service overview
Averazon is an online platform for group purchases of pop-culture and leisure products, organised as “Team Drops”. Contractual terms for ordering, payment, delivery, cancellation and withdrawal are set out in the terms and conditions of sale, which govern any sale concluded with the Publisher.
See the terms and conditions of sale.
User account
Some features require an Account. Information provided must be accurate, truthful and kept up to date. Credentials (including passwords) are strictly personal and confidential; the User is solely responsible for their use.
The Publisher may suspend or close an Account in the event of breach of these ToU, proven or suspected fraud, threat to Site security, or legal obligation, with notice where required by law.
Rules of use
The User undertakes, without limitation, to:
- comply with applicable laws and regulations, including intellectual property, personal data protection, consumer protection and e-commerce rules;
- not harm proper operation of the Site (intrusion, unauthorised vulnerability testing, overload, bypassing security measures, abusive automated scraping, etc.);
- not distribute unlawful, defamatory, hateful or violent Content, unsolicited sexual content, or Content infringing others’ privacy;
- not impersonate a third party or create confusion as to affiliation;
- not misuse the Site for systematic unauthorised resale of community benefits or manipulation of pricing or referral mechanisms;
- not send mass unsolicited communications through Site channels.
The Publisher may remove Content that is manifestly unlawful or contrary to the ToU and cooperate with competent authorities.
User-generated content
The User retains rights in protectable Content they publish. They nevertheless grant the Publisher, free of charge, worldwide for the statutory protection period, a non-exclusive licence, transferable to strictly necessary technical subprocessors, to host, reproduce, display, adapt and distribute that Content on the Site and reasonably related support channels (e.g. display of a pseudonym or avatar).
The User warrants that they hold any required permissions and that their Content does not infringe third-party rights.
Intellectual property of the Site
The Site structure, databases, trademarks, logos, original copy, graphics, interfaces and the Publisher’s own software are protected. Any unauthorised reproduction or exploitation is prohibited. Third-party product marks and visuals remain the property of their owners and are shown for illustration only.
Personal data
Processing of personal data is described in the privacy policy, which supplements these ToU.
Third-party links and services
The Site may contain links to third-party sites or services. The Publisher exercises no control over them and disclaims liability for their content or practices; access is at the User’s sole risk.
Availability and changes
The Publisher strives to keep the Site accessible but does not guarantee uninterrupted availability or error-free operation. The Site may be changed, supplemented or suspended for maintenance or updates, with reasonable efforts to limit impact.
Liability
The User uses the Site at their own risk. To the fullest extent permitted by applicable law, and in particular mandatory consumer and EU rules, the Publisher’s liability shall not cover indirect or intangible loss (loss of opportunity, data loss, business loss) arising from use or inability to use the Site.
The Publisher shall not be liable for content published by Users or third parties, subject to legal moderation or takedown duties.
These ToU are not intended to exclude or limit liability that cannot legally be excluded or limited.
Force majeure
The Publisher shall not be liable for failure to perform obligations in the event of force majeure under French law or an event beyond reasonable control that was unforeseeable and insurmountable.
Governing law and disputes
These ToU are governed by French law. For disputes relating to non-contractual use of the Site, jurisdiction is assigned to the French courts, without prejudice to mandatory jurisdiction rules for consumers resident in another EU or EEA member state.
Changes to the ToU
The Publisher may change the ToU at any time. The version in force is the one published on the Site with its update date. Where required by law or where changes are material, more prominent notice may be given (banner, email to the Account holder). Continued use of the Site constitutes acceptance of the updated ToU, without prejudice to consumer rights.
Duration — termination
The ToU apply for as long as the Site is used. Deleting the Account or stopping use ends associated access rights, subject to statutory retention duties and pending disputes.
